Welcome to Joy Konark CBCT Academy. These Terms and Conditions ("Terms") govern your access to and use of our website masterclass.joykonark.com and your registration for the CBCT Implant Planning Masterclass.

By accessing our website and registering for our courses, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. Definitions

• "Academy," "we," "us," or "our" refers to Joy Konark CBCT Centre and Joy Konark CBCT Academy
• "Masterclass" or "Course" refers to the CBCT Implant Planning Masterclass
• "Participant," "you," or "your" refers to the individual registering for the masterclass
• "Website" refers to masterclass.joykonark.com
• "Services" refers to the educational services provided through the masterclass

2. Eligibility

To register for our masterclass, you must:

• Be at least 18 years of age
• Be a licensed dental professional or a dental student
• Provide accurate and complete registration information
• Have the legal capacity to enter into a binding agreement
• Comply with all applicable laws and regulations

By registering, you represent and warrant that you meet these eligibility requirements.

3. Registration and Payment

3.1 Registration Process

• Registration is completed through our online registration form
• All information provided must be accurate, current, and complete
• You are responsible for maintaining the confidentiality of your registration details
• Registration is subject to availability (limited to 50 seats)

3.2 Course Fees

• Part-1 Only: ₹999 (including applicable taxes)
• Part-1 + Part-2 Combo: ₹9,999 (including applicable taxes)
• All fees are quoted in Indian Rupees (INR)
• Promotional pricing is subject to change without notice

3.3 Payment Terms

• Payment must be completed at the time of registration
• We accept payment through Razorpay (credit card, debit card, UPI, net banking)
• Payment confirmation will be sent to your registered email
• Registration is confirmed only upon successful payment

3.4 Taxes

All applicable taxes, including GST, are included in the course fees. Tax invoices will be provided as per Indian tax regulations.

4. Cancellation and Refund Policy

4.1 Participant-Initiated Cancellation

• More than 7 days before course start: 100% refund minus processing fees (5%)
• 3-7 days before course start: 50% refund
• Less than 3 days before course start: No refund
• After course commencement: No refund

4.2 Academy-Initiated Cancellation

In the unlikely event that we cancel the masterclass, you will receive:

• Full refund of your course fees within 7-10 business days, OR
• Option to transfer to a future session at no additional cost

4.3 Refund Process

• Refund requests must be submitted in writing to info@joykonark.com
• Refunds will be processed within 7-10 business days of approval
• Refunds will be credited to the original payment method
• Processing fees and payment gateway charges are non-refundable

4.4 No-Show Policy

If you fail to attend the masterclass without prior notice, no refund will be provided. However, recording access may be provided at our discretion.

5. Course Access and Delivery

5.1 Course Format

• The masterclass will be conducted live online via Zoom
• Joining links will be sent to your registered email 24 hours before the session
• You must have a stable internet connection and compatible device
• System requirements: Computer/laptop/tablet with camera and microphone (recommended)

5.2 Recording Access

• Part-1 Only: 3 days recording access
• Part-1 + Part-2 Combo: 7 days recording access
• Recordings are for personal use only and may not be shared or distributed
• Recording links will expire after the specified access period

5.3 Course Materials

• Digital course materials will be provided via email
• Materials are for personal, non-commercial use only
• You may not reproduce, distribute, or sell course materials

5.4 Technical Support

We will provide reasonable technical support for accessing the course. However, we are not responsible for:

• Internet connectivity issues on your end
• Hardware or software compatibility problems
• Third-party platform outages (Zoom, etc.)

6. Intellectual Property Rights

6.1 Course Content

All course content, including but not limited to videos, presentations, documents, images, and materials, are the intellectual property of Joy Konark CBCT Centre and are protected by copyright laws.

6.2 Restrictions

You agree NOT to:

• Record, screenshot, or capture course sessions without permission
• Share, distribute, or sell course materials to third parties
• Use course content for commercial purposes
• Modify or create derivative works from course content
• Remove copyright or proprietary notices

6.3 Limited License

Upon payment, we grant you a limited, non-exclusive, non-transferable license to access and use the course content solely for your personal educational purposes.

7. Participant Code of Conduct

As a participant, you agree to:

• Maintain professional and respectful behavior during sessions
• Not disrupt or interfere with the learning experience of others
• Protect the privacy and confidentiality of other participants
• Not engage in harassment, discrimination, or offensive behavior
• Follow instructions provided by the instructor and moderators
• Use the WhatsApp community group (if applicable) appropriately

We reserve the right to remove any participant who violates this code of conduct without refund.

8. Certification

• Certificates will be issued upon successful completion of the masterclass
• Attendance at live sessions is required for certification (minimum 80% attendance)
• Certificates are digital and will be sent via email
• Certificates are for educational purposes and do not constitute professional licensure
• The Academy reserves the right to verify attendance before issuing certificates

9. Disclaimers and Warranties

9.1 Educational Purpose

The masterclass is provided for educational and informational purposes only. It does not constitute medical advice or professional consultation. Participants should use their professional judgment when applying course concepts to clinical practice.

9.2 No Guarantee of Results

While we strive to provide high-quality education, we do not guarantee specific outcomes, results, or improvements in your professional practice.

9.3 "As Is" Basis

The course and materials are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.4 Medical Professional Responsibility

Participants remain solely responsible for their clinical decisions and patient care. The Academy is not liable for any decisions or actions taken based on course content.

10. Limitation of Liability

To the maximum extent permitted by law, Joy Konark CBCT Centre, its instructors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or technical failures
• Any damages arising from your use or inability to use the course
• Any reliance on course content for clinical decisions

Our total liability shall not exceed the amount you paid for the course.

11. Indemnification

You agree to indemnify, defend, and hold harmless Joy Konark CBCT Centre, its instructors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your misuse of course content
• Your clinical practice decisions

12. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last Updated" date. Material changes will be communicated via email to registered participants.

Your continued use of our services after changes constitute acceptance of the modified Terms.

14. Course Changes and Cancellations by Academy

We reserve the right to:

• Modify course content, schedule, or format with reasonable notice
• Substitute instructors if necessary
• Cancel or postpone the course due to unforeseen circumstances
• Combine sessions or modify delivery methods

In case of significant changes, registered participants will be notified and given appropriate options (refund, transfer, or acceptance of changes).

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

15.3 Dispute Resolution

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiations. If negotiations fail, either party may pursue formal legal remedies.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Joy Konark CBCT Centre regarding the masterclass and supersede all prior agreements and understandings.

18. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• Acts of government or regulatory authorities
• Internet or telecommunications failures
• Pandemics or public health emergencies
• War, civil unrest, or terrorism
